Viva Health is committed to protecting the privacy of personal information we collect and hold about individuals. This privacy policy’s purpose is to provide information to you, our client or visitor to our website, on how your personal information (which may include personal health information) is collected and used within this private practice, and the circumstances in which we may share it with third parties. 2. Why and when your consent is necessary?
When you consent to being a client of ours, you provide consent for our therapists and clinic staff to access and use your personal information so they can provide you with the best possible therapy and care. Providing personal, health and medical information to Viva Health helps Viva Health staff to provide appropriate treatment. You do not have to give all your personal and health related information, but if you don’t, this may affect the quality and level of service we are able to provide to you. Only staff who need to see your personal information will have access to it. If we need to use your information for anything else, we will seek additional consent from you to do this.
3. Why do we collect, use, hold and share your personal information?
Viva Health will need to collect your personal information to provide therapy services to you. Our main purpose for collecting, using, holding and sharing your personal information is to provide suitable therapy and care. We also use it for direct related business activities, such as financial claims and payments and business processes where required.

· Representative/s and/or emergency contacts telephone number and email
· Health, medical and disability information

5. How do we collect personal information?
Client personal information may be collected from:
· You, the client
· Your family members or significant others
· Your advocate/representative
· Your doctor or other service providers or facilities
We will collect personal information directly from you unless:
· We have your consent to collect the information form someone else
· We are required or authorised by law to collect the information from someone else
· It is unreasonable or impractical to do so.
We may collect personal information in several different ways:
· When you are first referred to our service or when you make your first appointment with Viva Health.
· During the course of providing therapy services we may collect further personal information from you.
· We may also collect your personal information when you visit our website, send us an email or SMS, telephone us, make an online appointment or communicate with us using other forms such as social media.
· With your consent personal information may also be collected from other sources.
6. Disclosure of personal information
We may disclose your personal and health information for the purpose of your care and services, to:
Service providers who assist us in providing care and services, medical practitioners, external health agencies such as the ambulance service, hospitals, the National Disability Insurance Scheme, and other relevant government organisations
A person you have nominated as being your advocate/representative, e.g. parent, child or sibling, spouse, a relative, a member of your household, a guardian, an enduring power of attorney, or a person you have nominated to be contacted in case of emergency, provided they are at least 18 years of age.
We may NOT use or disclose personal information for a purpose other than providing care and service unless:

The purpose is related to providing care and services, and you would reasonably expect disclosure of the information for that purpose.
We believe on reasonable grounds that the disclosure is necessary to prevent or lessen a serious and imminent threat to your life, health or safety or a serious threat to public health or public safety.
We have reason to suspect unlawful activity and disclosure is required or authorised by law.
We will NOT disclose your personal information to an overseas recipient

We take all reasonable steps to ensure that the personal information we hold is protected against misuse, loss, unauthorised access, modification or disclosure. We hold personal information in both hard copy and electronic forms in secure databases on secure premises and on secure, cloud-based technology, accessible only by authorised Viva Health staff.

Under the Privacy Act, you have a right to access your personal information that is collected and held by us. If at any time you would like to access or change the personal information that we hold about you, or you would like more information on our approach to privacy, please contact us.
To obtain access to your personal information you will need to provide us with proof of identity. We will take all reasonable steps to provide access to your personal information within fourteen (14) days from your request.

It is important to us that your personal information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

In event of a privacy data breach at Viva Health we will notify affected person/s as soon as possible and implement Viva Health’s Management of Data Breach Policy and Procedure.

Our website collects cookies. A cookie is a small file that resides on your computer and is recognised by our server when you visit our website/s. A cookie does not provide us with personal identifiable information however it does provide details of you IP address, the computer platform that you use, the browser that you use and what domain you are accessing.

Viva Health may at times send marketing email to recipients who have opted in via our website or other means. If you no longer want to receive these email from Viva Health you may click the unsubscribe link in the email or contact us directly to remove yourself from our email list.
14. Anti-Spam Policy
We have a no spam policy and provide you with the ability to opt-out of our communications by using the unsubscribe link at the footer of all Viva Health emails. We will not sell, rent or share your email. If you are having difficulty unsubscribing please email hello@vivahealth.com.au

We retain your Personal Data for the minimum amount of time necessary to provide you with the information and/or services that you requested from Viva Health. We may include certain Personal Data for longer periods of time if necessary for legal, contractual and accounting obligations.
